1. Who we are
This Privacy Policy is published by Hamble Creek Holdings LLC ("Hamble Creek Holdings", "we", "us" or "our"). It explains how we handle personal information on our website, in the software products we operate and in the text messages we send.
In some products we act for an organization that uses the product, such as a club, a business or a landlord (an "Organization"). When we process personal information on an Organization's behalf, the Organization decides why it is collected and we handle it under its instructions; that Organization's own privacy notice also applies, and you should direct requests about that information to it. Where we decide why and how information is used, we are the controller of it.
2. Information we collect
Depending on how you use the website and our products, we collect:
- Information you give us: your name, email address, organization, mobile phone number, the topic and text of a message you send through a contact form, and anything else you choose to provide when you ask about, register for or use a product.
- Account information: login username, role, the Organization you belong to, preferences such as language and time zone, and the records an Organization asks us to hold for you in a product.
- Text-message records: your mobile number, the date, time and wording of the consent you gave, the messages we send you and any replies (including STOP and HELP), and delivery status reported by the carrier or our messaging provider.
- Device and usage information: browser type, device type, pages viewed, approximate location derived from the network address, and performance and error data. On our public website we measure this with Google Firebase Analytics and Performance Monitoring.
- Security information: records of sign-ins, security checks and actions on sensitive data, which we keep to protect accounts and to meet our audit obligations.
3. How we use information
We use personal information to:
- respond to your enquiries and provide the products and features you ask for;
- create and secure accounts, verify identity and prevent fraud and abuse;
- send service messages by email and text, such as sign-in codes, appointment and schedule reminders, billing and account notices and security alerts;
- operate, measure, troubleshoot and improve the website and our products;
- meet legal, tax, accounting and audit obligations and enforce our terms.
4. Text messaging (SMS)
We send text messages only to people who have given their consent to receive them, in the way described in our Terms and Conditions. The messages are transactional or service-related (for example verification codes, reminders and account or service alerts), sent by Hamble Creek Holdings LLC, or by us on behalf of an Organization you have a relationship with.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties.
We pass your mobile number and message content only to the communications providers and wireless carriers that deliver the messages for us, and only for that purpose. Those providers act under contract on our instructions and may not use the information for their own marketing.
You can stop text messages at any time by replying STOP to any message. Reply HELP for help. Message and data rates may apply. See our Terms and Conditions for the full program terms.
5. How we share information
We do not sell personal information, and we do not share it for cross-context behavioral advertising. We share it only as follows:
- With Organizations, when you use a product provided through an Organization and the information relates to your relationship with it.
- With service providers that host our systems, send email and text messages, process payments, measure usage and provide support, under contracts that limit their use of the information to providing the service to us.
- To comply with law, a court order or a lawful request from a public authority, or to protect the rights, safety and property of you, us or others.
- In connection with a merger, financing, acquisition or sale of all or part of our business, subject to the protections of this policy.
- With your direction or consent.
6. Cookies and analytics
We use browser storage and similar technologies that are needed to remember your language, colour scheme and sign-in, and, on our public website, measurement tools that tell us which pages are visited and how fast they load. We do not use them to build advertising profiles. You can block or clear them in your browser settings; parts of the products may not work without the essential ones.
7. How long we keep information
We keep personal information for as long as it is needed for the purpose it was collected, to provide the products, and to meet legal, tax, accounting and audit requirements; financial records are kept for the period the law requires. When information is no longer needed we delete it or remove what identifies you. Backups age out on a fixed schedule.
8. How we protect information
We use administrative, technical and physical safeguards that fit the sensitivity of the information, including encryption in transit, encryption of especially sensitive fields, access limited by role, step-up verification for sensitive actions and audit logs. No method of transmission or storage is completely secure, so we cannot promise absolute security. If a breach affects your personal information we will notify you and the authorities as the law requires.
9. Your choices and rights
You can ask us to access, correct, delete or export the personal information we hold about you, to restrict or object to some uses, or to withdraw a consent you gave, by writing to info@hamblecreekholdings.com. We may need to verify your identity first, and we may decline a request where the law allows or requires. Depending on where you live, you may also have the right to appeal our decision and to complain to a data-protection authority. We will not discriminate against you for exercising these rights.
Email: you can unsubscribe from any marketing email with the link in it; we will still send service messages. Text: reply STOP to any message to opt out of text messages.
10. Children's privacy
Our website is not directed to children under 13 and we do not knowingly collect personal information from a child under 13 through it. Some products are used by families or youth organizations; in those, information about a child under 13 is collected only with verifiable consent from a parent or guardian, is limited to what the product needs, is never used for behavioral advertising and is deleted at a parent's request. If you believe a child has given us information without permission, contact us and we will remove it.
11. Where information is processed
We operate in the United States, and information we collect is processed and stored there. If you use our services from elsewhere, you understand that your information will be transferred to and handled in the United States, which may have different data-protection rules than your country.
12. Changes to this policy
We may update this policy. We will post the new version here with a new effective date, and where a change is material we will tell you through the site or by email before it takes effect.
